SUPPLEMENTAL TERMS AND CONDITIONS
For Job Seekers
THE
TERMS AND CONDITIONS SET FORTH BELOW SUPPLEMENT AND MODIFY
THE TERMS AND CONDITIONS OF THE IEEE WEB SITE WITH RESPECT
TO THE USE OF THE IEEE JOB SITE SERVICE. THE IEEE JOB
SITE SERVICE IS OPERATED SEPARATELY FROM ALL OTHER IEEE
SITES AND SERVICES AND HAS DIFFERENT INFORMATION COLLECTION
AND USE PRACTICES. YOUR USE OF THE IEEE JOB SITE SERVICE
IS CONDITIONED UPON YOUR AGREEMENT TO BE BOUND BY THE
IEEE TERMS AND CONDITIONS AS MODIFIED BY THESE SUPPLEMENTAL
TERMS AND CONDITIONS.
You
should read the IEEE Terms and Conditions (the "Terms
and Conditions") and these supplemental terms and
conditions (these "Supplemental Terms and Conditions")
carefully. By clicking the "Accept" button,
you affirmatively agree to abide by the Terms and Conditions
as modified by these Supplemental Terms and Conditions
with respect to the IEEE Job Site Service (the "IEEE
Job Site Service"). As used below, the terms "You"
and "User" mean any IEEE member who activates
a personal user account on the IEEE Job Site Service.
Any
capitalized terms used but not defined herein have the
meanings ascribed to them in the Terms and Conditions.
1.
Privacy
- Types
of Information Collected
In
connection with your use of the IEEE Job Site Service,
we ask for and may collect information from and about
you in different ways and at different points on the
service. Some of the information that you submit may
be personally identifiable information (that is, information
that can be uniquely identified with you). First, in
order to participate in the IEEE Job Site Service, you
must join the IEEE. When you join the IEEE, the IEEE
collects certain personally identifiable information,
including your name, address (physical and email), and
general educational and professional background ("Member
Information"). [If you have instructed the IEEE
to not include your Member Information in its mailing
lists or membership directory, your opt-out will not
apply to sharing within the IEEE Job Site Service if
you sign up for Job Site.] Second, to begin using the
IEEE Job Site Service, you will be asked to register
by opening a personal user account. Through the online
registration form certain information, including job
type, salary range and desired location of employment
("Registration Information") is collected.
An asterisk indicates which information is mandatory
in order to complete the registration process. Third,
if you choose to submit information for a particular
job posting, you may be asked to complete a more extensive
employer-specific questionnaire (an "Employer Questionnaire")
to provide additional information to fine-tune your
qualifications and candidacy for that specific job posting
("Candidacy Information"). Your Membership
Information, Registration Information and Candidacy
Information are collectively referred to below as your
"Employment Information."
- Use
of Information
By
the Job Seeker
Once
you have activated your IEEE Job Site personal user
account, the IEEE submits your Registration Information
to the IEEE Job Site profiling engine to attempt to
match your information with available job postings.
Upon a match of your Registration Information with a
job posting, the IEEE will notify you via email if you
have elected to receive such notifications. Upon reviewing
a job posting, your Employment Information will be forwarded
to that potential employer only if you click on the
"Submit" button, thereby instructing the IEEE
to forward the Employment Information to the potential
employer.
By
the Potential Employer
The
IEEE has granted potential employers the right to run
searches through the IEEE Job Site profiling engine
to match their job postings with job seekers Registration
Information. No personally identifiable information
is released to these potential employers during these
searches, and potential employers are not able to contact
job seekers through this portion of the IEEE Job Site
Service. If you instruct the IEEE to share your Employment
Information with a potential employer, the potential
employer has agreed to treat that information as confidential
and to not disclose it to any third party without your
prior written consent.
Third
Parties
The IEEE has contracted with CareerCast, a third party
Application Service Provider to implement and host the
IEEE Job Site Service. Information collected from you
and potential employers will be stored on CareerCast's
server and processed through its profiling engine.

identifiable information to any third party.]
- Disclosure
of Information
Your
Employment Information is released only when you choose
to do so, and your information is only released to the
potential employer who posted the job to which you are
responding. Once your Employment Information has been
forwarded to a potential employer, all correspondences
are directly between you and that potential employer.
Employers have agreed to not disclose your Employment
Information to third parties.
As
a user of the IEEE Job Site Service, you may restrict
distribution of your Employment Information by indicating
such restrictions in your account. The IEEE will not
send unsolicited promotional messages (as opposed to
administrative messages) to users of the IEEE Job Site
Service who indicate that they do not wish to receive
such messages.
As
indicated above, you will be informed at each collection
point what information is required and what information
is optional. If the IEEE Job Site Service matches your
Registration Information with a particular job posting,
you will be notified by email only if you have chosen
to receive such notifications. You may opt out of receiving
email notifications at any time.
- Access
You
can access your Employment Information by logging into
your account by using your name and password at http://www.ieee.org/jobs.
Once there, you can modify and delete any part of your
Employment Information.
- Ownership
and Use of Content
The
IEEE or its licensors own exclusively all content on
this Job Site site including, but not limited to, graphics,
logos, text, data, downloadable software, page layout
and look and feel of the IEEE Job Site web pages (the
"Content"). The Content is protected under
U.S. and international copyright laws. Except for the
license granted herein, your use of the IEEE Job Site
Service gives you no rights in the IEEEs or its
licensors copyrights, trademarks, trade secrets
or any other intellectual property rights.
The
IEEE grants to you a personal, non-transferable and
non-exclusive right to access and use the Content
solely for your own personal use in connection with
your search for a job for yourself or for career information
and in accordance with the Terms and Conditions and
these Supplemental Terms and Conditions. No portion
of the Content may be, disclosed to, or modified,
copied, sold, leased, distributed, transmitted or
used for any commercial purpose or on behalf of any
other person or entity.
You
agree not to incorporate the Content into another
database, search engine or networked computer environment
of any kind. You may not access the Content by means
of any automated processes, spiders, bots or similar
devices or interfere or attempt to interfere with
the proper operation of the IEEE Job Site Service.
You agree not to modify, copy, transmit, create derivative
works from, reverse engineer, disassemble, or otherwise
attempt to discover any source code from, any software
accessible or available through the IEEE Job Site
Service, or sell, assign, sub-license or otherwise
transfer any right in such software.
The
IEEE will terminate the accounts of any users, and
block access to the IEEE Job Site Service of any users,
who are infringers of the copyrights, or other intellectual
property rights, of the IEEE and others. The IEEE
reserves the right to take these actions at any time,
in its sole discretions, with or without notice, and
without any liability to the user whose account is
terminated or to the user whose access is denied.
2.
Use of the Job Site Service
In
consideration of your use of the IEEE Job Site Service,
you agree not to use the IEEE Job Site Service only
to locate job opportunities and obtain career information
as described above. You agree not to (a) use the IEEE
Job Site Service for any fraudulent, illegal, harassing
or offensive activity including, but not limited to,
the submission of sexually explicit material or content
inappropriate for viewing by minors, or which is likely
to offend or criticize any employer, employee, group
or portion of society, and (b) provide any information
where such provision constitutes the infringement or
violation of any right of any third party. You agree
not to engage in any activity that would impair the
proper functioning of the IEEE Job Site Service and
its Content. Specifically, you agree not to provide
any false or misleading information or engage in any
activity to defeat any security or feature of the IEEE
Job Site Service. You agree not to post any incomplete,
false or misleading biographical information or information
that is not about you (and you represent that you are
a living individual seeking employment on a full-time
or part-time basis on his or her own behalf). You agree
to not delete or revise any Content posted by any other
person or entity. If you take any of the prohibited
actions described above, or if the IEEE has reasonable
grounds to suspect that you have taken any of the prohibited
actions described above, the IEEE may suspend or terminate
your account and refuse any and all current and future
use of the IEEE Job Site Service.
The
IEEE may terminate or suspend your ability to access
the IEEE Job Site Service and its Content and any other
service the IEEE may provide to you at any time for
any reason, with or without notice.
3.
Only a Venue; Disclaimers
IEEE
Job Site is only a venue. IEEE Job Site acts as a venue
for employers to post job opportunities and candidates
to post resumes and does not screen or censor the listings
offered. The IEEE is not involved in the actual transaction
between employers and candidates. As a result, neither
the IEEE nor its agents have control over the quality,
safety or legality of the jobs or resumes posted, the
truth or accuracy of the listings, the ability of employers
to offer job opportunities to candidates or the ability
of candidates to fill job openings. In addition, note
that there are risks, including but not limited to the
risk of physical harm, of dealing with strangers, foreign
nationals, underage persons or people acting under false
pretenses. You assume all risks associated with dealing
with other users whom you come in contact through the
IEEE Job Site Service.
The
IEEE does not review or confirm the accuracy of any
Content, personally identifiable information or job
postings on the IEEE Job Site Service, but reserves
the right to review and reject any information it believes
to be contrary to the Terms and Conditions or these
Supplemental Terms and Conditions. The IEEE reserves
the right to remove any Content, personally identifiable
information or job postings, deactivate any account,
or otherwise terminate access to the IEEE Job Site Service
for violation of any of the Terms and Conditions or
these Supplemental Terms and Conditions, or if otherwise
compelled by court order. The IEEE does not endorse
or sponsor in any way the activities, products, services
or policies of any person or company which posts information
on, or which serves as part of, the IEEE Job Site Service.
The IEEE accepts no responsibility for the accuracy
or completeness of any Content posted, or the hiring
practices or policies of potential employers.
4.
Trademarks
IEEE
is a trademark or service mark of the IEEE and CareerCast
is a trademark or service mark of CareerCast Inc.. The
IEEE and CareerCast do not grant to you any rights under
the Terms and Conditions or these Supplemental Terms
and Conditions with respect to these trademarks or any
other trademarks of either the IEEE or CareerCast.
5.
Indemnification
You
agree to promptly indemnify the IEEE and its officers,
directors, employees, members, agents and affiliates
("Associates") for all damages, liabilities,
costs, charges and expenses, including reasonable legal
and accounting fees ("Costs"), that the IEEE
or its Associates incur as a result of your breach of
the Terms and Conditions, these Supplemental Terms and
Conditions or any Costs relating to the Content or in
any way relating to your conduct with any other user
of the IEEE Job Site Service. The IEEE shall provide
to you timely notice of any claim, suit or proceeding
which could give rise to an indemnification obligation
hereunder.
6.
Disclaimers
IN
ADDITION TO THE OTHER PROVISIONS OF THE TERMS AND CONDITIONS
FOR THE SITE, ALL DISCLAIMERS BY THE IEEE SET FORTH IN
THE TERMS AND CONDITIONS APPLY TO YOUR USE OF THE IEEE
JOB SITE SERVICE.
7.
Termination
These
Supplemental Terms and Conditions are effective until
terminated by either the IEEE or you. If you no longer
agree to be bound by these Supplemental Terms and Conditions,
you must cease your use of the IEEE Job Site Service.
Subject to applicable law, the IEEE reserves the right
to suspend or deny, in its sole discretion, your access
to all or any portion of the IEEE Job Site Service with
or without notice. You agree that any termination of
your access to the IEEE Job Site Service may be effected
without prior notice, and acknowledge and agree that
the IEEE may immediately deactivate or delete your account
and all related information and files in your account
and bar any further access to such files or the IEEE
Job Site Service. Further, you agree that the IEEE shall
not be liable to you or any third party for any termination
of your access to the IEEE Job Site Service.
